The present general terms and conditions of sale were updated on 01/07/2020 and have been applicable since that date on the website Montessori-toys.co.uk.
Article 1 : Scope and Modification of the GTC
These General Terms and Conditions of Sale are intended to define the contractual relationship between the seller (the Montessori Toys website) and the buyer (the client).
These conditions apply to all orders placed on the website Montessori-toys.co.uk, whether the buyer is a professional or a consumer. The acquisition of a good through this website implies unconditional acceptance by the buyer of the following General Terms and Conditions of Sale.
Montessori Toys reserves the right to adapt or modify these general terms and conditions of sale at any time. In the event of modification, the general terms and conditions of sale in effect on the date of the order will apply to each order.
The sale of products by Montessori Toys is subject to French law. Any dispute relating to the existence, interpretation, execution, or termination of the contract concluded between Montessori Toys and the client, even in the case of multiple defendants, will, in the absence of an amicable agreement, fall under the exclusive jurisdiction of the French courts.

Article 3 : Contractual Conditions
3.1. Capacity to Contract
Any customer of the company Montessori-Toys declares to have full legal capacity to contract under the conditions described herein, meaning being an emancipated minor or having reached the age of majority and not being under protection as per Article 488 of the Civil Code.
Montessori-Toys reserves the right to refuse any order from a customer with whom a dispute exists or arises during the processing of an order, particularly a payment dispute.
3.2. Acceptance of Terms by the Customer
These conditions can be read directly on the website montessori-toys.co.uk, in the "General Terms and Conditions of Sale" section. Upon simple request by the customer, they can also be sent in PDF format via email.
By checking the box "I have read the general terms and conditions of sale and I accept them without reservation" before proceeding with secure payment, the customer provides an irrevocable acceptance that can only be questioned in the limited cases provided in these general terms and conditions of sale under paragraph 8.3 "Refusal on the grounds of Withdrawal." The customer acknowledges having read and understood these conditions and accepts them.
Purchasing by phone also implies acceptance of these terms, which the customer acknowledges having previously read, understood, and accepted under the aforementioned conditions.
3.3. Placing an Order
Individual customers can place their orders on the website https://montessori-toys.co.uk online 24/7.
When the customer clicks on "Add to Cart," a confirmation message appears where it is possible to select "Continue Shopping" or "Proceed to Checkout." By selecting "Proceed to Checkout," the selection of products is complete, and the customer is in the ordering process.
The ordering process consists of 5 successive steps, which are:
• Step 1: Cart Summary
Identify the selected products with the various product characteristics (colors, sizes, etc.) as well as the desired quantities. Shipping costs can also be estimated based on the chosen delivery method.
• Step 2: Sign In
Identify yourself either by entering your email address and password, which are strictly personal, or by providing all the information usually requested for online registration. It is also possible to place an order without creating a customer account (not recommended).
• Step 3: Address
Complete or modify the shipping and billing addresses if necessary. By default, they are the same; however, you can enter a different billing address from the shipping address by unchecking the box "Use this address for billing as well." The necessary delivery information should not be incorrect or incomplete, particularly concerning potential accessibility restrictions to the delivery location (building, floor, access code, etc.).
• Step 4: Delivery
Choose the available delivery method(s). Next to each delivery method, the delivery time and cost are indicated. At this stage, it is also possible to choose to wrap the order in gift paper by checking the box "I would like my order to be wrapped in gift paper."
• Step 5: Payment
After a final clear summary of the order, the customer must indicate the chosen payment method. Once the payment method is selected, the customer must proceed with the payment of their order on the secure interface, which will firmly and definitively formalize the sales contract binding them to Montessori-Toy. It is also at this stage that the customer must acknowledge the following General Terms and Conditions of Sale by checking the box "I have read the general terms and conditions of sale and I accept them without reservation."
Any order implies acceptance of the prices and description of the products available for sale.
Order processing, preparation, and packaging fees (excluding gift wrapping) are included in the shipping costs.
3.4. Order Validation
The customer validates their order by clicking on the "Order with obligation to pay" button at the bottom of the "Payment" step. Before this validation, the customer is systematically offered the opportunity to check each element of their order to correct any possible errors.
In any case, the customer's final validation of the order will be proof of the order and will imply the requirement to pay for the selected products in the order. This validation constitutes a signature and acceptance of all operations carried out on the website https://montessori-toys.co.uk.
3.5. Order Confirmation by Email
The company Montessori-Toys confirms the order by email, provided that the email address indicated on the registration form is error-free. This information includes all the elements of the order. The customer must verify the completeness and accuracy of the information they provide to Montessori Toys. Our company cannot be held responsible for any data entry errors and their consequences, such as delays or delivery errors. In this context, all costs incurred for reshipping will be borne by the customer.
If you do not receive your order confirmation email, it may have been sent to your spam folder. If this is not the case, please contact our customer service.
3.6. Electronic Signature
According to the law of March 13, 2000, on electronic signatures, any order form signed by the consumer by "double-clicking" constitutes an irrevocable acceptance that can only be challenged within the limits provided in these general terms and conditions of sale.
The "double-click" associated with the authentication and non-repudiation procedure and the integrity protection of messages constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.
3.7. Modification of Customer Data
The customer can identify and correct errors made when entering their data at any time. When they notice an error after the conclusion of the contract, they must contact Customer Service. However, after the order confirmation email is sent, Montessori Toys does not guarantee that the delivery address can be modified (especially if the order has been shipped).
3.8. Order Tracking
The customer can consult the status of their order at any time by visiting the "Order History" section on the website https://montessori-toys.co.uk.
This tracking allows the customer to know the preparation status of their order. When the order has been shipped, the delivery tracking number will be displayed. Montessori Toys cannot be held responsible for any unavailability or errors that may affect the information provided by its carriers. The customer can contact Customer Service at any time to get information about their order status.
3.9. Proof of the Order
The computerized records stored in the information systems of the company Montessori Toys under reasonable security conditions will be considered proof of communications, orders, and payments made between the parties. The archiving of order forms and invoices is carried out on a reliable and durable medium that can be produced as evidence.
The data recorded by the company Montessori Toys constitutes proof of the nature, content, and date of the order. These are archived by our company under legal conditions and deadlines. The customer can access this archiving by contacting Customer Service.
3.10. Gift Wrapping Option
It is possible to opt for gift wrapping to receive your order wrapped and/or with a personalized card. To do this, you must:
either add the "Gift Option" product to the cart, visible in all categories of the site;
or at step 3 of the order process (3. Delivery Method) by checking the box "I would like my order to be wrapped in gift paper (additional cost of €7.00 incl. tax)."
The gift wrapping option rates are:
- Gift wrapping alone charged at €4.99,
- Personalized card alone charged at €2.99,
- Gift wrapping + personalized card charged at €6.99.
The order will be shipped without a personalized card if no message or indication is provided:
either in the "Gift Option" product in the "Message to include on the card" text field;
or in the shopping cart at step 3 of the order process (3. Delivery Method) in the "If you would like to add a comment to your order, please write it in the field below" text field.
The gift wrapping option is not compatible with the prismatic ball product.
Article 4 : Information on the Products Offered
4.1. Product Characteristics
The characteristics of the products offered for sale are presented in each corresponding product sheet. The photographs are not contractual. All texts presented on our site are reserved worldwide under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited.
4.2. Identification of Discounted Products
Discounted products are identifiable by a "PROMO" label on the product image or a red strikethrough price.
4.3. Product Availability
Montessori Toys commits to fulfilling orders received only within the limits of available product stocks.
Availability may vary within the same day depending on the sales level. Montessori Toys frequently updates availability but cannot be held responsible if the stock is not as indicated. More precise information can be provided to the customer by phone and email.
The unavailability of a product is mentioned on the concerned product page. The shipping times indicated in the descriptive sheets are indicative when the product(s) are not available in our company's stock. They may therefore vary, for which the customer will be informed in their order tracking in case of a slight delay or by email in case of a prolonged delay.
If Montessori Toys cannot obtain an ordered product from its suppliers, the company will notify the customer of the expected delay by email. In this case, we commit to contacting you within 5 days from the order validation to offer you:
- either delivery of the ordered product with a longer delivery time,
- or a proposal for a similar or superior quality product at a similar price,
- or a refund of the product in question.
In the event of a stock shortage on one of the products in your order, we will contact you to apply one of these conditions:
- either sending the rest of the available order, then sending the unavailable products as soon as they are back in stock (subject to Customer Service approval),
- or sending your complete order as soon as the out-of-stock products become available,
- or canceling the entire order and refunding it.
No cancellation penalty will be applied for such an order cancellation. No cancellation indemnity (other than the full refund of the order including shipping costs) can also be requested, as such unavailability results from the delay in updating availability. However, in all the above-mentioned cases, we commit to sending you a 10% voucher for the unavailable products for the inconvenience caused.
4.4. Product Price
Prices are indicated in euros, including all taxes, and are only applicable on the date of order validation. As Montessori Toys's supplier rates constantly evolve, the prices displayed on the site may change at any time. However, the prices cannot be changed once the customer's order is placed. The prices do not include shipping costs, potential promotional offers, and personal discounts, indicated before the final order validation. There is no VAT included in the prices indicated, as our company is a micro-enterprise (VAT not applicable, art. 293B of the CGI).
Orders destined for countries outside the European Union are subject to any taxes and customs duties of the destination country. These costs and related formalities are the responsibility of the recipient. They must be paid directly to the carrier upon delivery.
4.5. Product Warranty
All our products are guaranteed for 2 years from the date of receipt of the product.
In case of using the warranty, our Customer Service must be contacted. To properly process your request, please provide your order reference and complete contact details.
After receiving and accepting the package by our services, depending on the nature of the product, the available stocks, and the buyer's wishes, we offer :
- either to send you the ordered product repaired,
- or to send you a similar or superior quality product,
- or to refund the product in question + shipping costs on a pro-rata basis for returned items, by the same payment method used for the purchase (unless otherwise agreed between the parties). This refund will be sent to the buyer within a maximum of 15 days from the date of receipt of the package by Montessori Toys.
- or to refund you partially or entirely for the product in question + the shipping costs on a pro-rata basis for returned items, in the form of a voucher with an additional percentage offered (percentage chosen by the seller according to the nature of the product and the observed defect), valid for 6 months from the date of receipt by the customer, without a minimum purchase.
Article 5 : Payment and Security
5.1. Payment Methods
The available payment methods for purchases made on our site are:
- PayPal
- Bank transfer
- Credit card (Visa, Mastercard)
- Coinbase (cryptocurrency)
These payments are secured by an SSL certification, which you can identify by the URL of our site beginning with https.
The order will only be processed after receipt of payment (except for administrative mandate payments). The customer guarantees Montessori Toys that they have the necessary authorizations to use the payment method they chose when validating the order form and undertakes to honor the payment of their order. The customer's account will be debited at the time the order is processed.
Montessori Toys reserves the right to suspend any order management and delivery in case of refusal of payment authorization by credit card from officially accredited organizations or in case of non-payment. Montessori Toys also reserves the right to refuse delivery or honor an order from a customer who has not fully or partially settled a previous order or with whom a payment dispute is ongoing.
5.2. Details of Payment by PayPal
The PayPal account associated with our company is: [email protected].
If the customer uses PayPal as a payment method, the order is validated immediately. This payment method generates additional fees to offset PayPal commissions.
5.3. Details of Payment by Bank Transfer
The bank transfer payment details are indicated on the order summary page once the payment method is selected and validated. You can find them below. The customer must indicate the order reference when making the transfer.
After selecting the bank transfer as the payment method, your order is reserved for 14 days. Beyond this period, without receipt of the bank transfer associated with your order, it will be canceled.

5.4. Details of Payment by Credit Card
Credit card payments (Visa or Mastercard) are made via the Stripe company.
If the customer uses Stripe as a payment method, the order is validated immediately. All Stripe commission fees are graciously covered by the site.
5.5. Details of Payment by Coinbase
Payments by cryptocurrency (Bitcoin, Bitcoin Cash, DAI, Ethereum, Litecoin, and USD Coin) are made via the Coinbase company.
After selecting payment by Coinbase as the payment method, your order is reserved for 14 days. Beyond this period, without receipt of the cryptocurrency payment associated with your order, it will be canceled.
5.6. Invoice
The order confirmation sent by email to the customer by Montessori Toys does not constitute an invoice.
The customer can access the original invoice from their online account by going to the "Order History" section and selecting the order reference. The invoice is only available from when the order is shipped, and the order status is "Shipped."
The invoice is not included in the package.
We keep an electronic copy of each invoice.
Article 6 : Delivery
6.1. Delivery Service
Products are delivered to the delivery address provided during the order process. For package tracking reasons, we cannot deliver orders to military bases or other military facilities without prior agreement.
The ordered product is delivered by various carriers, depending on the nature of the product ordered and at the sole discretion of Montessori Toys, to the address indicated on the order form. Delivery tracking is provided on the online account upon notification of the order's shipment via email.
The customer must verify the completeness and accuracy of the information provided to Montessori Toys. Our company cannot be held responsible for any data entry errors and their consequences in terms of delays or delivery errors. In this context, any costs incurred for reshipping will be the customer's responsibility.
6.2. Shipping Costs
For all orders, we cover the costs of preparation and packaging free of charge, with no minimum purchase.
Free in-person pick-up is available in Juvignac (34 - Hérault FRANCE), with no minimum order.
To meet all needs, several delivery methods are offered on the site: tracked letter (for small products), Mondial Relay, Colissimo, UPS, Chronopost or TNT. The shipping costs are automatically calculated during the order process based on the weight, size of the products ordered, and the delivery address.
6.3. Order Preparation Time
Your order is shipped within a maximum of 3 working days after receipt of payment (if products are in stock).
It may happen that some products are out of stock. In this case, it is indicated in the product description and in an email upon order confirmation. When the restocking time exceeds 2 weeks, the order is sent in two shipments, incurring additional shipping costs. Otherwise, the order is shipped as soon as all ordered products are back in stock.
For custom-made products (e.g., prismatic ball), to provide you with lower prices, we reduce intermediaries, which is why our service providers send your order directly to you. Therefore, it is possible that you may receive multiple packages for a single order if it contains personalized products.
6.4. Delivery Times
An email is automatically sent to the customer when the products are shipped. Upon receipt of the shipping confirmation email, the customer can consider the delivery times of the various shipping methods announced during the order process.
Delivery times depend on the delivery address and the carrier chosen during the order. Montessori Toys provides customers with indicative delivery times announced by these carriers.
Please note:
- For payments other than credit card and PayPal, the order is confirmed only when we validate the receipt of payment.
- For payment by administrative mandate, the order is confirmed only once the administrative mandate form and order confirmation have been received by our services.
6.5. Delivery Zones
The geographical delivery area of the Montessori Toys store is as follows:

- World: Africa, North America, South America, Central America / Caribbean, Asia, Europe outside the European Union, Maghreb, Oceania.
6.6. Packaging
The products are packaged to comply with current transport standards and to ensure optimal protection of the products during delivery. The customer is asked to follow these same standards for any product return. In the case of a product return, if we find that the product is returned damaged due to insufficient quality packaging, Montessori Toys may decide to refund only part of the product or refuse to refund it if it cannot be resold in its current condition.
6.7. Absence or Delay of Delivery
In the absence of delivery by the indicated date or, failing that, more than 15 days after the maximum date indicated at the time of order, the buyer may instruct the seller to deliver the goods within an additional reasonable period. If, despite everything, the delivery does not occur, the buyer may request the cancellation of the sale. The seller must then refund all amounts paid by the buyer (including shipping costs) as soon as possible and at the latest within 14 days.
However, we may be exempt from liability if the non-performance results from an act of the consumer or the occurrence of an event beyond the consumer's control (see Article 9 "Force Majeure" in the General Terms and Conditions of Sale).
6.8. Damaged Package
Under the legal warranty of conformity, the buyer may refuse or return the package if it is damaged during transport (see paragraph 2.7 "Returns for Refusal"). If the buyer has accepted the package and wishes to return it, they must inform Customer Service as soon as possible so that our services can take the necessary steps promptly.
However, Montessori Toys may be exempt from liability by proving that the non-performance or improper performance of the contract is attributable to the buyer, to an unforeseeable and insurmountable event by a third party, or to a case of force majeure (see Article 9 "Force Majeure" in the General Terms and Conditions of Sale).
Article 7: Responsibilities
7.1. Responsibilities Regarding the Choice and Purchase of a Product
The choice and purchase of a product or service are the sole responsibility of the customer. The total or partial inability to use the products cannot give rise to any compensation, refund, or liability on the part of Montessori Toys, except in cases where specific criteria (dimensions, weight, etc.) have been agreed upon between Montessori Toys and the buyer.
7.2. Responsibilities Regarding the Products
The products offered comply with current French legislation and standards applicable in France. Montessori Toys cannot be held liable in case of non-compliance with the legislation of the country where the product is delivered. The customer is responsible for checking with local authorities the possibilities of importing or using the products they intend to order.
Hypertext links may redirect to other sites than the Montessori-toys.co.uk site; we disclaim any responsibility if the content of these sites contravenes the legal and regulatory provisions in force.
Article 8 : Return Policy
8.1. General Return Procedure and Conditions
To ensure optimal handling of returns, any product that needs to be returned must first be approved by our customer service department; otherwise, it will be refused. To initiate a return request, please contact our Customer Service (via email at [email protected] with your order number as the subject, or by phone at +33 6 58 59 27 12, available daily from 10:30 AM to 11:00 PM). The time frame within which you must contact Customer Service depends on the reason for the return (see different reasons below).
Upon receiving approval from Customer Service, you have 14 days to return the product. Returns made after this period will be refused. We recommend using a tracked shipping method for the return. If the package, sent by you, does not reach us, you will not be able to initiate an inquiry with the postal services to locate it, as only the sender of the package can start such an inquiry. Please note that any package not shipped by us is not our responsibility.
To properly process your request, please include your order reference number and complete contact details.
The customer must provide the tracking number of the returned package (within 48 hours of sending) and the reasons for the return by email to [email protected] or through the "Contact Us" section.
8.2. Returns for "Incorrect Item Received"
In accordance with legal provisions, you have 14 days from the day after receipt of your product to notify us that the product received is not the product ordered. To process your request correctly, please provide your order reference and complete contact details.
No returns will be accepted if the returned product is unsuitable for resale. Therefore, the product must be returned in perfect condition, in its original packaging, undamaged, and unmarked. Otherwise, the product will be returned to you at your expense.
Upon receipt and acceptance of the return by our services, depending on the nature of the product, available stock, and the buyer's preference, we offer the following options:
- Delivery of the originally ordered product.
- Offering a similar or superior quality product at a similar price if the originally ordered product is unavailable.
- A refund for the product in question plus a proportionate amount of the shipping costs, through the same payment method used for the purchase (unless otherwise agreed). This refund will be issued to the buyer within a maximum of 15 days from the date of receipt of the package by Montessori-Toys.
- A refund for the product in question plus a proportionate amount of the shipping costs, in the form of a store credit with 10% of the order value added, valid for 6 months from the date of issuance.
8.3. Returns for "Withdrawal"
In accordance with legal provisions, you may exercise your right of withdrawal within 14 days following the receipt of your product, excluding the day of receipt. If this period ends on a Saturday, Sunday, or public holiday, it is extended to the next business day. There is no penalty to pay; however, return shipping costs are the responsibility of the customer.
If the buyer wishes to exercise their right of withdrawal, they must contact Customer Service to receive the withdrawal form. To process the return request correctly, please provide the order reference number during this contact.
The right of withdrawal also applies to discounted and clearance items. However, in accordance with legal provisions, the right of withdrawal cannot be exercised for personalized products and items made to order.
No returns will be accepted if the returned product is unsuitable for resale. Therefore, the product must be returned in perfect condition, in its original packaging, undamaged, and unmarked. Otherwise, the product will be returned to you at your expense.
Upon receipt and acceptance of the return by our services, depending on the nature of the product, available stock, and the buyer's preference, we offer the following options:
- Offering an exchange product of equivalent value.
- A refund for the product in question, through the same payment method used for the purchase (unless otherwise agreed). This refund will be issued to the buyer within a maximum of 15 days from the date of receipt of the package by Montessori-Toys.
- A refund for the product in question in the form of a store credit, valid for 6 months from the date of issuance.
8.4. Returns for "Not at Address"
The "Not at Address" reason applies to packages returned by the delivery provider with the mention: "Does Not Reside at the Indicated Address."
The customer must verify the completeness and accuracy of the information provided to Montessori-Toys. Our company cannot be held responsible for any input errors and their consequences in terms of delay or delivery errors. In this context, all costs incurred for re-shipment will be borne by the customer.
Upon receipt and acceptance of the returned package by our services, we will contact the buyer to offer the following options:
- Re-shipment of the order, subject to additional re-shipment fees.
- A refund of the total amount of the order, minus shipping costs, through the same payment method used for the purchase (unless otherwise agreed). This refund will be issued to the buyer within a maximum of 15 days from the date of receipt of the return package by Montessori-Toys.
- A refund of the total amount of the order, minus shipping costs, in the form of a store credit with 10% of the order value added, valid for 6 months from the date of issuance.
8.5. Returns for "Unclaimed"
The "Unclaimed" reason applies to packages that have not been collected by customers from the post office or pickup point within the allotted time.
The customer is responsible for verifying the completeness and accuracy of the information provided to Montessori-Toys. Our company cannot be held liable for any input errors and their consequences in terms of delays or delivery errors. In this context, all costs incurred for reshipment will be borne by the customer.
If a pickup point is no longer available (either because it is closed or has too many packages, making it unavailable), the nearest possible pickup point to the delivery address will be chosen automatically. The buyer will then receive an email from our Customer Service informing them of the address of the new pickup point where their order has been sent.
A delivery notice in the mailbox (for home deliveries only) or an email and/or SMS will be sent to the buyer to inform them of the location where the order can be picked up. A period of 1 to 2 weeks will be allowed for picking up the order at the indicated pickup point before it is returned to us.
Upon receipt and acceptance of the returned package by our services, we will contact the buyer to offer:
- Reshipping the order, subject to additional reshipment fees.
- A refund of the total order amount, minus shipping costs, through the same payment method used for the purchase (unless otherwise agreed). This refund will be issued to the buyer within a maximum of 15 days from the date of receipt of the return package by Montessori-Toys.
- A refund of the total order amount, minus shipping costs, in the form of a store credit with 10% of the order value added, valid for 6 months from the date of issuance.
8.6. Returns for "Refused"
The "Refused" reason applies to packages that were refused at the time of delivery by the buyer.
Upon receipt and acceptance of the return by our services, depending on the nature of the product, available stock, and the buyer's preference, we offer:
- An exchange product of equivalent value.
- A refund for the product in question, through the same payment method used for the purchase (unless otherwise agreed). This refund will be issued to the buyer within a maximum of 15 days from the date of receipt of the package by Montessori-Toys.
- A refund for the product in question in the form of a store credit, valid for 6 months from the date of issuance.
Article 9 : Force majeure
Neither party shall be considered in breach of its contractual obligations if their performance is delayed, hindered, or prevented by a fortuitous event or force majeure.
A fortuitous event or force majeure includes any irresistible facts or circumstances beyond the control of the parties, which are unpredictable, unavoidable, and independent of the parties' will, and which cannot be prevented despite all reasonable efforts.
The party affected by such circumstances shall notify the other party within 10 working days of becoming aware of the event. The parties shall then consult each other within one month, unless prevented by the force majeure event, to examine the impact of the event and agree on the conditions under which the contract will continue. If the force majeure event lasts more than 3 months, the present terms and conditions may be terminated by the affected party.
Specifically, the following are considered cases of force majeure or fortuitous events, in addition to those usually recognized by French courts and tribunals:
- Total or partial strikes, internal or external to the company, blockage of means of transport or supply for any reason, governmental or legal restrictions, computer failures, earthquakes, fires, storms, floods, lightning;
- The stoppage of telecommunications networks or difficulties specific to external telecommunications networks to the clients.
